CONTRACT MANAGEMENT AND ADMINISTRATION (CMAD)

The objective of the professional program in Contact Management and Administration is to provide the necessary knowledge and practical tools that contract personnel needs to acquire to effectively and efficiently manage contracts and construction claims.

Program Requirements

Core Courses

CMAD 010
 CMAD 010: Contract Laws

This course is designed to give an overview of the legal framework within which contracts are formulated and executed with specific application to construction contracts. The course gives a basic legal background, which is necessary to be known by the contract administrator of any given project, in respect of Contract formation, elements, conditions of validity and execution under Egyptian law. This course is considered the basis for many other courses in the program, such as FIDIC and Claims.

CMAD 020
 CMAD 020: Understanding FIDIC and Standard Forms of Contracts

FIDIC stands for Fédération Internationale des Ingénieurs-Conseils, French for the International Federation of Consulting Engineers. The FIDIC standard forms of contracts are becoming among the most common standard contracts used worldwide. Understanding FIDIC provisions is essential in most of the International Projects/Business especially if funded by the World Bank. Proper administration of a FIDIC contract is essential in order to ensure the protection of the parties’ rights and to ascertain their positions in the event that a dispute arises. The main objective of this course is to provide an in-depth understanding of the FIDIC Red Book contracts and assist the parties to effectively administer such contracts.

 CMAD 030 CMAD 030: Principle and Management of Construction Claims

This course introduces in details the construction claims The main objective of this course is to assist mid-management-levels and seniors to learn more about the different methods to administer construction claims and the ways to reserve their rights and entitlements under the construction contract.

 CMAD 040 CMAD 040: Arbitration and Dispute Resolution- Theory and Practice

This course will give candidates an understanding of the principles of good practice and procedure of the different dispute resolution mechanisms and a thorough overview of the main alternative dispute resolution processes. The program consists of a series of lectures and interactive discussions that will lead the candidate through his/her learning journey of litigation, arbitration, mediation and adjudication. Being the most used dispute resolution mechanism in the business arena, the course will have more focus and emphasis on arbitration: international and domestic.

 CMAD 050
 CMAD 050: Contract Administration

The course provides tools of contract administration. The course targets various project management practitioners as the contract administration is deeply interconnected with all project’s disciplines and departments. The course will provide the fundamentals of contract administration from the transitional stage between the pre-contract and post-contract signature till the expiry of the defects notification period and close-out of the project, going through all the key duties required to be performed and delivered by all stakeholders related to the contract administration practice.

 CMAD 060 CMAD 060: Construction Delays and Time Analysis

This course introduces both academic and practical aspects therein. The attendees will have a chance to practice simple delay analysis exercise on Primavera and try it themselves. The course will also introduce the relevant UK and US legal concepts as well as legal concepts under the civil code. This will mean distinguishing US and UK from MENA laws being the most in the region.

 CMAD 070
 CMAD 070: Guidelines for Contracting Procedures for IFA

This course is designed to give an overview of the bidding procedures and documents issued by the international funding agencies such as the World Bank, European Bank for Reconstruction and Development and African Development Bank. The Course provides guidance on preparing a bidding document based on the standard bidding document for procurement of works as well as evaluating the tenders submitted by the bidders. The course is essential for those working in the fields of procurement and tendering either in administrative bodies or in the private sector.
